These Terms of Service set out the general terms that apply when using the Davina Digital Agency website and engaging us for digital marketing services.
Davina Digital Agency is a trading name of Davina Connect Ltd.
Davina Digital Agency provides digital marketing services which may include website design and build, SEO, social media management, content, email marketing, paid campaigns and outsourced marketing services.
The exact services, deliverables, price, timescale and any specific conditions for client work will be confirmed in the relevant quotation, proposal, order or service agreement.
Information on this website is provided for general information about our services. Package descriptions and published prices are subject to their stated scope and may not cover every business requirement.
Where a service is shown as “from” a particular price, the final price depends on the agreed scope and will be confirmed before work begins.
Clients are responsible for providing accurate information, suitable content, required access, approvals and feedback within reasonable timescales.
Delays in providing content, access, information, feedback or approvals may affect agreed delivery dates or campaign schedules.
Our work is delivered according to the agreed scope. Changes in priorities may sometimes be accommodated within an existing service where agreed, but they do not automatically increase the package allowance or available delivery capacity.
Additional pages, platforms, content, campaigns, functionality, integrations, revisions or other material work outside the agreed scope may be separately quoted.
Unless otherwise agreed in writing, recurring Davina Digital Agency services have an initial minimum term of three months.
During the initial minimum term, fees are payable in advance according to the agreed payment schedule. The initial term is a committed period and cannot normally be cancelled for convenience during that period.
After the initial term, recurring services continue on a rolling monthly basis unless otherwise agreed, with one month's written notice required to end the service.
Website builds and other project-based work may be subject to separate payment stages, delivery schedules, revision allowances and project-specific terms confirmed in the relevant proposal or agreement.
Advertising spend, premium themes, plugins, software, licences, hosting, external suppliers, specialist services and other third-party costs are not included unless expressly stated in the agreed proposal.
Where additional third-party costs become necessary during delivery, we will seek approval before committing those costs wherever reasonably possible.
Where we manage paid advertising, advertising spend is separate from our management fee unless explicitly stated otherwise. Advertising platforms, search engines and social networks control their own systems and results.
Marketing performance depends on many factors outside our control. We do not guarantee specific search rankings, traffic levels, follower growth, leads, sales, revenue or other commercial outcomes unless a particular commitment is expressly agreed in writing.
Ownership and permitted use of project-specific work will be governed by the relevant proposal or agreement. Clients must have appropriate rights or permission to provide us with logos, images, text, trademarks and other materials used in their project.
We are not responsible for changes, restrictions, suspensions, outages or decisions made by third-party platforms such as search engines, social networks, website platforms, hosting providers, advertising platforms or software providers.
We aim to keep this website accurate and available but do not guarantee uninterrupted or error-free access.
Nothing in these terms excludes or limits liability where it would be unlawful to do so. Any additional limitations or allocation of liability relating to paid client work will be contained in the applicable service agreement or proposal.
Termination rights and any obligations that continue after termination will be governed by the applicable proposal, contract or service agreement as well as these general terms.
